1. Service provider
HolaClics (trade name), Tax ID (NIF) Z0848512R, Calle Zulaida 11, 03170 Rojales (Alicante), Spain. Email: info@holaclics.com. Telephone: +34 613 13 87 84.
2. Who the services are for
HolaClics services are intended for businesses and professionals, for the purposes of their activity. By placing an order, the client declares that they are acting for business or professional purposes. If, notwithstanding this, they contract as a consumer, they retain all the rights granted to them by law (see section 8).
3. Services, prices and VAT
- The services, what they include and exclude, and their price are those published on the pricing page at the time of ordering, or those set out in the quotation accepted in writing where the work is quoted per project.
- There are two payment methods: a one-off payment (the website) and a monthly fee (social media, local SEO and advertising management).
- Prices are expressed in euros and include Spanish VAT (IVA, 21 %), unless expressly stated otherwise.
- The advertising budget invested in Google, Meta or other platforms is not included: the client pays it directly to those platforms.
4. How to order
- Online: the client creates an account in the client area, chooses the service and pays on the secure Stripe page. The contract is concluded when Stripe confirms the payment; the client receives a confirmation email and can find their invoices in the client area.
- By quotation: for work quoted per project, the contract is concluded when the client accepts the quotation in writing (an email is sufficient).
- The contract may be concluded in Spanish, English, French, German or Dutch. In the event of any discrepancy between language versions of these terms, the Spanish version shall prevail. HolaClics keeps a record of each order and the client may request a copy.
5. Payments, monthly fees and renewal
- Online payment is made by card through Stripe. Work carried out under a quotation is paid as set out in the quotation.
- Monthly fees are charged in advance at the start of each month of service and renew automatically every month until the client cancels them.
- If a payment fails, HolaClics will notify the client and may suspend the corresponding service until the payment is settled.
- If HolaClics changes the price of a monthly fee, it will give at least 30 days' notice by email; the client may cancel before the change takes effect.
6. Duration and cancellation
- Monthly fees carry no minimum term, except for packages that include the website at no cost: in that case the minimum commitment is six months, and this is stated before ordering.
- The client may cancel a monthly fee at any time, with 30 days' notice, from the Stripe customer portal (accessible from the client area, invoices section) or by writing to info@holaclics.com. Cancellation takes effect at the latest at the end of the month of service in which those 30 days expire.
- No refund is given for a month of service that has already begun.
- The one-off payment website has no monthly fee and no automatic renewal. Hosting and the domain name from the second year onwards are invoiced separately, as set out on the pricing page.
7. Performance of the service and client obligations
- HolaClics provides its services with the diligence of a professional in the sector. This is an obligation of means: no ranking on Google and no number of enquiries or sales is guaranteed.
- The client provides in good time the information, texts, images and access credentials required (Google Business Profile, advertising accounts, social media, domain name). Timeframes run from the moment HolaClics has them; delays in providing them extend the timeframes.
- The client warrants that they hold the rights to the content, trade marks and images they supply, and remain their owner.
8. Right of withdrawal
Clients who contract as a business or professional have no right of withdrawal: the law grants that right only to consumers.
If the client is a consumer, they may withdraw from the contract within 14 calendar days of its conclusion, without giving any reason (articles 102 et seq. of Real Decreto Legislativo 1/2007), by informing us through any unequivocal means, for example by sending the following text to info@holaclics.com: “I hereby give notice that I withdraw from my contract for the provision of the following service: [service], ordered on [date]. Name, address, date and signature (if sent on paper)”. HolaClics will refund the payments received within a maximum of 14 days, using the same means of payment. If the consumer expressly requested that the service begin during the withdrawal period, they shall pay for the part already provided (article 108.3); and they shall lose the right of withdrawal once the service has been fully performed with their express consent (article 103.a).
9. Liability
With regard to clients who contract as a business or professional, the total liability of HolaClics on any ground relating to the service is limited to the amount actually paid by that client in the twelve (12) months preceding the event giving rise to it, and loss of profit and indirect damage are excluded. This limitation does not apply in the event of wilful misconduct or gross negligence, nor to the rights that the law grants to consumers. The other exclusions are set out in the legal notice.
10. Governing law, jurisdiction and complaints
The contract is governed by Spanish law. The courts and tribunals of Alicante have jurisdiction over any dispute, unless the client is a consumer, in which case the courts of the client's place of residence shall have jurisdiction. Any complaint or claim may be sent to info@holaclics.com.
