2. Purpose of the website

HolaClics is a digital marketing agency working for businesses and professionals on the Costa Blanca: website design and development, search engine optimisation (local SEO), social media management, management of advertising campaigns on Google and Meta, photography and video, and NFC devices for reviews. The website presents these services, publishes their prices, offers informative content and provides access to a client area.

HolaClics is not Google, Meta or any other platform mentioned on the website, nor does it act on their behalf. The advertising budget that the client invests in those platforms is paid directly to them.

3. Terms of use

• Access to the website is free of charge and unrestricted. Using it makes you a user and implies acceptance of these terms in the version published at the time of access.
• The user undertakes to use the website lawfully, not to introduce viruses or harmful code, not to attempt to access restricted areas or other people's accounts, and not to use the website or its forms to send unsolicited communications.
• The data that the user provides through the forms, by email or in the client area must be accurate and their own, or belong to a third party who has authorised them to provide it.
• The client area requires an account. The client is responsible for keeping their password safe and for everything done with their account, and must notify us if they suspect any misuse.
• HolaClics may modify, suspend or withdraw content or services from the website, and update these terms. The date of the latest version is shown on this page.

4. Exclusion and limitation of liability

• Indicative information. The content of the website (guides, articles, examples, timeframes, market figures, regulations cited, estimates from the price simulator) is general and informative in nature, reflects the date on which it was published and does not constitute legal, tax or technical advice. What binds HolaClics is the price published on the pricing page at the time of ordering or the quotation accepted in writing.
• No guarantee of results. HolaClics does not guarantee any specific ranking on Google or any number of enquiries or sales: these depend on search engines, advertising platforms, competition and the market, which it does not control.
• Third-party content. The case studies, reviews, data or other third-party content appearing on the website come from those third parties or from public sources. HolaClics does not guarantee their accuracy or currency and will correct or remove anything reported to it as inaccurate.
• Links. Links to third-party websites (Google, WhatsApp, Calendly, Stripe and others) are provided for reference. HolaClics does not control and is not liable for their content, availability or policies (article 17 of the LSSI-CE) and will remove any link as soon as it has actual knowledge that it leads to unlawful content.
• No intermediation. HolaClics is not a party to the contracts that the user enters into with third parties (advertising platforms, suppliers, the user's own customers), unless a contract with HolaClics expressly states otherwise.
• Availability. Uninterrupted access to the website and the absence of errors are not guaranteed. HolaClics takes reasonable security measures but is not liable for damage caused by interruptions, breakdowns, viruses or attacks beyond its control.
• Force majeure. HolaClics is not liable for any failure or delay in performance due to causes beyond its reasonable control: outages of hosting, communications or payment providers, changes to third-party platforms, disasters, decisions of public authorities or strikes.
• Limit with regard to professionals. With regard to clients who contract as a business or professional, the total liability of HolaClics on any ground relating to the service is limited to the amount actually paid by that client in the twelve (12) months preceding the event giving rise to it, and loss of profit and indirect damage are excluded.
• Nothing in the foregoing limits liability for wilful misconduct or gross negligence, nor the rights that consumer legislation (Real Decreto Legislativo 1/2007) grants to anyone acting as a consumer.

5. Intellectual and industrial property

The texts, design, code, logos, the trade name HolaClics, and the original photographs and videos of this website belong to its owner or are used under licence. Short extracts may be quoted with a link to the source. Any reproduction, distribution, public communication or transformation, in whole or in part, without written authorisation is prohibited.

Third-party trade marks, logos and content appearing on the website belong to their respective owners. Anyone who considers that content infringes their rights may write to info@holaclics.com, and the content will be removed once the claim has been verified.

6. Data protection and cookies

The processing of personal data is explained in the privacy policy, and the use of cookies in the cookie policy. The terms governing paid services are set out in the terms of sale.

7. Governing law and jurisdiction

These terms are governed by Spanish law. The courts and tribunals of Alicante have jurisdiction over any dispute, unless the user acts as a consumer, in which case the courts of the user's place of residence shall have jurisdiction.
